These Terms of Service ("Terms") govern your use of abaculus.xyz and its Services. By accessing or using the Services, you ("you," "user") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 10 years old to use the Services. Minors between 10 and 18 require parental/guardian consent.
You represent that you have the legal capacity to enter into these Terms (or have parental/guardian consent if applicable).
We reserve the right to verify your age and terminate accounts that violate eligibility requirements.
2. Account Registration & Usage
You must create an account to access premium features (e.g., ad-free play, premium levels). You agree to provide accurate, current, and complete information during registration.
You are solely responsible for maintaining the confidentiality of your account credentials (username, password) and all activities conducted under your account.
Account sharing, selling, or transferring to third parties is prohibited. We may suspend or terminate accounts for unauthorized access or sharing.

3. Game Rules & Conduct
You agree to use the Services lawfully and in compliance with these Terms. Prohibited conduct includes:
Using cheats, bots, or third-party software to bypass puzzles, unlock levels, or access premium content without payment.
Modifying game files or using exploits to gain an unfair advantage in puzzle completion times.
Harassing, bullying, or discriminating against other users (e.g., toxic comments in puzzle discussion forums) or our moderation team.
Posting or sharing inappropriate content (e.g., explicit material, hate speech) in user profiles or feedback sections.
Infringing on third-party intellectual property (e.g., using copyrighted images in custom mosaic submissions).
4. In-Game Purchases & Virtual Items
Virtual items (e.g., hint packs, cosmetic mosaic skins, premium levels) are licensed to you, not sold. You have no ownership rights, and items are non-transferable.
All purchases are final. Refunds are granted only in cases of technical errors (e.g., duplicate charges, undelivered items) reported within 7 days of purchase.
We reserve the right to adjust virtual item pricing, availability, or functionality at any time without prior notice.
5. Intellectual Property
All content on the Services (e.g., game code, puzzles, graphics, trademarks) is owned by us or our licensors and protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any Service content without our prior written permission.
You retain ownership of user-generated content (e.g., custom mosaic designs, forum posts) but grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote such content in connection with the Services.
6. Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, or non-infringement.
We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Services (e.g., loss of puzzle progress, account suspension, or device damage), even if we are notified of the possibility of such damages.
Our total liability to you shall not exceed $45. This limitation applies regardless of the legal theory (contract, tort, or otherwise).
7. Termination
We may suspend or terminate your account and access to the Services at any time, with or without notice, if you violate these Terms, engage in prohibited conduct, or for any other reason in our sole discretion.
Upon termination, your right to use the Services ceases, and we may delete your account and associated data (subject to data retention laws).

8. Governing Law & DisputesThese Terms are governed by the laws of the State of Illinois, United States. Any disputes arising from these Terms or the Services shall be resolved through arbitration in Chicago, IL, in accordance with the rules of the American Arbitration Association.
